Part 1 in April 2019 was on how claims in respect of Variations and Extensions of Time should be dealt with during the life of the project. Part 2 in June 2019 was on Alternative Dispute Resolution (ADR) and in particular, the process of Expert Determination (which is contained in the 2018 Ashghal contract as well as other standard forms in Qatar) as an intermediate step towards resolution of claims without using courts or arbitral tribunals.
Part 3 provided an overview of the data analytics tools and techniques available which can help unlock the value of the data gathered during construction and support the processes and procedures discussed in the first two events.
Whilst delivery organisations have seen considerable benefits of using CAD / BIM tools, Scheduling and Cost Management Software, ERP systems and even email to more effectively manage their projects, disputes and claims, with the specific exception of delay analysis, still largely rely on the use of more manual, hard copy focused techniques to support their work. Key messages included:
- There are more efficient ways of doing this which take advantage of the great advances in data capture and analytics technologies from other industries where data is recognized as a key organisational resource which can be leveraged to great advantage.
- Construction generates significant volumes of data during delivery which is stored in electronic formats which, if you have the data science capability to capture, integrate and analyse it, can deliver significant benefits during construction delivery and, when it doesn’t go to plan, disputes.
- Using tools and techniques such a electronic discovery to search and review project documents and communications, machine learning to supplement and support expert analysis and other analytics tools to clearly and efficiently communicate insights and analysis, significant efficiencies can be delivered over current methods through more shorter analysis timescales, more effective utilization of expert resources and, where analysis tools are put in place early enough, potential avoidance of the dispute in its entirety

Timur Korshlow is the head of PwC’s Forensic Data Analytics practice in the Middle East. He has notable experience in managing combined teams of data and construction subject matter experts to deliver data-driven insights in support of forensic investigations and large commercial/delay disputes. Timur has designed and delivered innovative solutions that helped organisations manage the risk of fraud and project failure using advanced data mining techniques in order to detect patterns of suspicious activity. These solutions resulted in several million pounds of recoveries and savings. Timur’s experience spans the full breadth of the data analytics life-cycle from capturing requirements and preparing data, through to data analysis and the presentation of results utilising effective data visualisation techniques.
Sion Rhys leads PwC’s Electronic Discovery practice across the Middle East, specialising in using advanced technology to mine large unstructured data sets, identify critical records and make them available to analysts, investigators and reviewers. Sion introduces technologies to projects which enable cost effective mining and categorisation of document and communication records, saving time and effort for the reviewers. He has significant experience in large scale discovery exercises where there is a need to scan enterprise systems for files, emails and other records for actionable information.
Alastair Grey leads PwC’s Disputes Practice in the Middle East. He is a Chartered Quantity Surveyor and qualified adjudicator with extensive experience in the adjudication of disputes in a broad range of international building and civil engineering, oil and gas projects. Alastair has been appointed to act as Expert Witness relating to Quantum matters on a number of occasions and has extensive experience in the management of litigation, arbitration and adjudication proceedings in the Middle East, Far East and Australia. Alastair works hand in hand with our Data Analytics and e-Discovery teams to target high value opportunities where technology can significantly improve the efficiency and effectiveness of our services.
Ahmad Al Ansari is Manager of the President’s Technical Office in Ashghal, the Public Works Authority (PWA). His previous roles include Head of Planning, Design & Contracts for the Qatar Olympic Committee on projects for the 2006 Asian Games and as Head of Water Projects for the Ministry of Electricity and Water. He is Chairman of the branch committee of CIArb Qatar.
Andrew Gardner-Mitchell is Director of Director of Planning & Programme Management at David Adamson & Partners Overseas. He moved to Doha in 2009 and has led planning, programme management, project control and delay analysis commissions on a number of high profile and challenging schemes in Qatar. Andrew is Chair of the CIOB Hub Committees for the MENA Region and for Qatar.
Don Ward is Head of the not-for-profit Constructing Excellence in Qatar which he set up as a partnership between Ashghal and the UK organisation Constructing Excellence. He has worked on best practice in Qatar construction for five years.
